01This agreement
These terms govern your use of Visibly. By creating an account or using the service you accept them; if you are accepting on behalf of an organisation, you confirm you are authorised to bind it, and “you” means that organisation.
Our Privacy Statement forms part of these terms and describes what happens to your data, including how long anything is kept.
02What the service does
You upload your evidence pack and a bank’s questionnaire. For each row of that questionnaire, Visibly drafts an answer, cites the document and section the answer rests on, rates its own confidence, explains the question in plain language, and — where your evidence cannot support an answer — says so and names what would close the gap. You get back a pre-filled questionnaire you can edit, re-run and export.
03What it is not
Stated as prominently as what it is, because this is the part that matters when something goes wrong:
- Not a decision engine. The output is a draft you review and the bank independently assesses — two human layers before any consequence.
- Not legal or regulatory advice. Citations point at your own evidence; regulatory references describe what a criterion is grounded in, not counsel. If you need advice on a regulation, get it from someone qualified to give it.
- Never a judgement about a person. Visibly assesses companies and documents. It does not score natural persons, and no protected attribute is an input.
- Not a substitute for your own review. The export flow is built to make an unreviewed export uncomfortable, never to replace the review.
04Accounts
Accounts are personal to the individual and require a work email address. Keep your credentials to yourself, use two-factor authentication, and tell us at support@visibly.sg if you think an account has been compromised. You are responsible for what happens under your account.
Your organisation may require two-factor authentication for everyone on its account. Where it does, we enforce it.
05Your documents stay yours
You keep all rights in the documents you upload and in the completed questionnaires you produce. You grant Visibly only the permission needed to run your assessment and deliver the result to you — nothing wider, nothing longer.
We train no AI on your data, and neither do the providers who process it on our behalf. That commitment is contractual, not a preference, and it is set out with its sources in the Privacy Statement.
You confirm that you have the right to upload what you upload, and that doing so breaks no confidentiality obligation you owe someone else.
06Assessing on behalf of a client
Consultants and advisers may run assessments for a client. If you do, you warrant that the client has authorised you to upload its documents and to run the assessment, and you indemnify us against claims arising from that authorisation not existing.
Where the service is used this way you will be asked to confirm the authorisation for each assessment. That confirmation is recorded, with both identities, as a timestamped event — it is evidence for you as much as for us.
07The output, and your review of it
Visibly’s output is generated by a probabilistic AI model. It can be wrong. It can miss something present in your documents, and it can phrase something in a way you would not.
- The output is not warranted to be accurate or complete, and is provided for your review.
- You must review it before relying on it or sending it to a bank. Where confidence is low or evidence is missing, Visibly says so on the row — that flag is there to be acted on.
- Once you submit an answer to a bank, it is your answer. You are responsible for its accuracy, as you would be for one you typed yourself.
We say the same thing inside the product, at the point where it matters, rather than only here.
08Sealed exports and verification
Some exports can be sealed, producing a verification reference a recipient can check. Be clear on what a seal means:
A seal certifies the integrity of the document as exported — that it has not been altered since. It certifies nothing about the truth of the underlying documents, and nothing about the vendor.
Every sealed export carries a line saying it was prepared with AI assistance from vendor-supplied documents and reviewed and submitted by the vendor, who is responsible for its accuracy. Removing or contradicting that line is a breach of these terms.
Verification pages disclose seal status only — never content. Anyone holding the reference can check it; treat the reference the way you would treat the document.
09Acceptable use
Do not:
- Upload material you have no right to upload, or that is unlawful.
- Use the service to mislead a bank — including submitting output you know to be unsupported by your evidence.
- Reverse engineer the service — decompile, disassemble, or otherwise attempt to derive its source code, its assessment logic, or the criteria, calibration and evidence tests behind it. The question set is published deliberately and is free to use; the judgement layer that applies it is not, and no part of the service is offered as a means of obtaining it.
- Access the service by automated means — scripts, bots, crawlers or scrapers — or extract its content in bulk.
- Use the service for competitive analysis, for benchmarking intended for publication, or to design, build or train a competing product or service.
- Attempt to manipulate the model through instructions embedded in uploaded documents, or probe for other customers’ data.
- Probe, scan or penetration-test the service without our written consent. Ask us first — see the security note on our contact page — and we will usually say yes.
- Resell or provide the service to third parties except as described in section 6.
We may suspend an account for a serious or repeated breach. We will tell you why.
10Availability and support
During the pilot the service is provided as-is, with no uptime commitment. We do not promise it will be uninterrupted or error-free, and processing times vary with the size of your document pack.
Support is by email at support@visibly.sg. Results are available for a limited window and then permanently deleted — see the retention section. Download what you need before the window closes; we cannot recover a purged assessment, by design.
11Liability
To the extent the law permits, and subject to the paragraph below:
- Our total liability arising out of or in connection with these terms is limited to the fees you paid for the service in the twelve months before the claim.
- We are not liable for indirect or consequential loss, or for loss of profit, business, contracts, goodwill, or anticipated savings, however arising.
- We are not liable for a decision a bank makes, or for the consequences of an answer you reviewed and submitted.
What we do not exclude.Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Limits are subject to the reasonableness test under Singapore’s Unfair Contract Terms Act. We would rather state a limit that holds than one that reads well and fails.
12Indemnity
You will indemnify us against claims arising from your breach of these terms, from documents you had no right to upload, or from an assessment run for a client without that client’s authorisation (section 6).
13Fees
No fees are charged during the pilot. When charging begins, prices, billing cycles and refund terms will be published and notified before they apply to you, and card details will be handled by the payment provider — never by us.
14Changes, and how we record them
These terms are versioned and dated. Material changes are notified to account holders before they take effect, and your acceptance is recorded as a timestamped event against the specific version you accepted — so both sides can say later, precisely, what was agreed and when.
15Ending the agreement
You may stop using Visibly and delete your account at any time; deletion works immediately and is confirmed in writing. We may end the agreement on reasonable notice, or immediately for a serious breach. Sections 5, 7, 11, 12 and 16 survive the end of the agreement.
16Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction. If part of these terms is unenforceable, the rest continues to apply.
